User Agreement

The Electronic Plans Room contains information about solicitation documents, plans, associated acquisition information, bidders, and other matters which may be of interest to members of the Builders & Contractors Exchange, Inc. Information reported in the project files is based on our review of the specifications; no plans have been reviewed. We try to ensure the accuracy of the information reported, but the Builders & Contractors Exchange offers no warranty, expressed or implied, that any of the reported information is accurate. We also attempt to ensure the information is current and timely, but the Exchange can guarantee neither of these. The best source of information for project files is the actual drawings and specifications maintained at the Exchange.

The Builders & Contractors Exchange expressly disclaims all warranties, including the warranties of merchantability and fitness for a particular purpose, in connection with the use or operation of the Electronic Plans Room.

The Builders & Contractors Exchange will not be liable for any losses, including lost data, information, profits, or any other incidents of consequential damages that may be sustained or arise from the use, operation, or ability to use or operate the Electronic Plans Room. In consideration for the privilege of using the Electronic Plans Room, User hereby release the Builders & Contractors Exchange, Inc., its officers, directors, employees, and the Webmaster from any and all claims arising from use of this system.

The information in the Electronic Plans Room is provided for the use of members of the Builders & Contractors Exchange. Our intent is to allow our members to access pertinent information via the World Wide Web and to view or download these documents onto their computer systems. We have also included the capability to allow members to e-mail comments, recommendations, questions, or other pertinent information to the Webmaster. While information in the Electronic Plans Room is provided for the use of the members, replication of this information for distribution is prohibited.

Any errors brought to the attention of the staff of the Exchange will be corrected as quickly as possible and to the best of our abilities. Some of the documents in the Electronic Plans Room contain "live links" to information created and maintained by other institutions. Please note that the Builders & Contractors Exchange does not endorse or control and cannot guarantee the relevance, timeliness, accuracy, or even the continued existence of these materials.

The Builders & Contractors Exchange reserves the right to control or limit access to the Electronic Plans Room. Access may be denied at any time for any reason. Access will be denied to any individual or company who uses the Electronic Plans Room for improper purposes. Access will be denied to anyone who uses obscene, abrasive, or otherwise questionable language on the system.

The Builders & Contractors Exchange reserves the right to monitor all information stored in any files, programs, or messages as well as the right to delete or edit any file, program, or message that contains, in the sole discretion of the staff of the Builders & Contractors Exchange, any obscene, abrasive, or otherwise objectionable language or material.

The U. S. Copyright laws prohibit the distributing or copying of copyright material without proper authorization. The Builders & Contractors Exchange will not tolerate any use of the Electronic Plans Room which, in any way, violates U. S. Copyright laws.

User must report to the Builders & Contractors Exchange Webmaster any use of the Electronic Plans Room which may represent a copyright infringement. If, in its sole discretion, the Exchange determines that any information has been loaded onto the Electronic Plans Room in violation of U. S. Copyright laws, the Builders & Contractors Exchange will delete such information. Any user who, without authorization, loads copyrighted information on the Electronic Plans Room, shall indemnify and hold harmless the Builders & Contractors Exchange, Inc., from any and all resulting claims and liability.
